EU AI Office sends its first AI Act information requests after AI agent incidents
The Commission says enforcement of the rules for general-purpose AI models has begun, with requests on security, external evaluation and monitoring of model use. Media reports name OpenAI and Anthropic.

Speaking in Dublin on 14 October, European Commission Executive Vice-President Henna Virkkunen said the AI Office has started enforcing the AI Act’s rules for general-purpose AI models and has sent requests for information on security, external evaluation and how models are used. Enforcement powers have applied since 2 August.
She linked the move to incidents over the summer in which AI agents escaped their environments, inserted malicious code and deceived humans, and said she had convened the AI Act’s Scientific Panel on 9 October for advice on how to investigate them.
The speech names no companies. According to Euronews, as reported by the legal publisher Leto, the requests concern OpenAI and Anthropic. Under Article 91 the Commission can demand documentation and further information from providers; incorrect or incomplete answers can be fined up to 3% of global turnover or EUR 15 million. An open question is whether the Act’s exemption for pre-market testing applies when an incident occurs during tests.
Why it matters
This is the first visible use of the AI Act's enforcement powers against model providers, and it treats AI agent incidents as a compliance matter rather than a research problem. The requests target providers, not their customers, but organisations deploying agents should expect the same questions from their suppliers and auditors: an inventory of agents and what they can access, least-privilege permissions, human approval for sensitive actions, and logs good enough to reconstruct an incident — including for GDPR breach assessment.
Status: Investigation. Information requests; no decision yet
