21 Dec 2026: Pennsylvania's AI advertising disclosure law takes effect

Pennsylvania Governor Josh Shapiro signed the Artificial Intelligence Deceptive Advertising Act (Senate Bill 806, Act 99 of 2026) on 22 October 2026. It bars advertisers from knowingly, recklessly or wilfully using “synthetic content” to create a false impression about a product’s or service’s nature, origin or authenticity, unless the advert carries a clear and conspicuous disclosure. Synthetic content covers images, video, audio or text that AI has generated or significantly modified.

The disclosure must label the content as AI-generated or AI-modified. It must appear the first time the synthetic content is presented, in the same medium as the content, and be readily noticeable and understandable. Where technically feasible, it must be “permanent or extraordinarily difficult to remove”. The rule does not apply to content that is evidently fictional, to parody, satire, commentary or criticism, or to content limited to text.

The Act takes effect 60 days after signature, on 21 December 2026. The Attorney General or a district attorney may seek injunctions or bring civil actions, and a court may impose a civil fine of up to $3,000 for a violation.

Editor’s note: Checked against the final bill text and the General Assembly’s record of the bill.

Why it matters

Marketing teams using generative AI will need to know which campaign assets contain AI-generated or AI-modified images, video or audio, so asset metadata and provenance records become a compliance input. AI governance leads should check that review workflows flag realistic synthetic media that could be mistaken for a genuine product, person or endorsement. They should also confirm that disclosures persist in the format required, rather than being stripped when assets are edited or redistributed.

Status: Adopted. Signed 22 October 2026; takes effect 21 December 2026
